Terms and Conditions

1) Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all contracts between Jessica Geiger Art (hereinafter referred to as the "Seller") and the customer (hereinafter referred to as the "Customer") for the online sale of artworks and other products of the Seller.

2) Contractual Partner
2.1 The contract is concluded with Jessica Geiger Art, Putzendoplergasse 2/3/8. You can reach us for questions, complaints, and objections at info@jessicageigerart.at.

3) Offer and Conclusion of Contract
3.1 The presentation of products in the online shop is not a legally binding offer but an invitation to order.

3.2 By clicking the "Buy" button, you place a binding order for the goods in the shopping cart.

3.3 The Seller can accept the Customer's offer within five days by sending the Customer a written order confirmation or a delivery confirmation. If the deadline passes without acceptance, the offer is deemed rejected.

4) Prices and Payment Conditions
4.1 The prices quoted are final prices and include the statutory value-added tax.

4.2 Payment can be made using various payment methods, which will be displayed at checkout and may vary by country.

5) Delivery and Shipping Costs
5.1 Delivery is made within 2-3 working days for prints and paintings up to 100x60 cm, usually sent via standard shipping. For original works larger than 100x60 cm, shipping may vary, but a "bulky goods transport" will be arranged within 2-3 working days.

5.2 Shipping costs are specified under the shipping conditions and costs and will be clearly communicated to the Customer before completing the order.

6) Right of Withdrawal
6.1 You have the right to withdraw from this contract within fourteen days without giving any reason.

6.2 The withdrawal period is fourteen days from the day you or a third party named by you, who is not the carrier, took possession of the goods. You must send a clear statement (e.g., via mail or email) of withdrawal to us within the withdrawal period.

Consequences of Withdrawal:

If you withdraw from this contract, we will reimburse you for all payments received from you, including delivery costs (except for additional costs arising from your choice of a different type of delivery than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction unless expressly agreed otherwise; in any event, you will not incur any fees for such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

7) Warranty
7.1 Warranty is provided according to legal regulations.

8) Copyright and Reproduction
8.1 All artworks and products offered in the online shop are subject to the copyright of the respective artist. The copyright remains unrestricted with the artist.

8.2 By purchasing an artwork, the customer acquires only a simple right of use for personal use. Any further use, especially reproduction, distribution, public disclosure, or modification, is prohibited without the express written consent of the artist.

8.3 Any reproduction, copy, or imitation of artworks for commercial purposes is strictly prohibited and constitutes a violation of copyright.

8.4 The customer undertakes to use the artworks and products exclusively within the legal provisions and the granted usage rights.

8.5 In case of a violation of these provisions, the artist reserves the right to take legal action and claim damages.

9) Data Protection
9.1 The data protection provisions can be viewed under Privacy Policy.

10) Applicable Law
10.1 Austrian law applies exclusively, excluding the UN Sales Convention.

11) Jurisdiction
11.1 The place of jurisdiction for all disputes arising from this contract is Vienna, as of January 28, 2023.

12) Alternative Dispute Resolution
12.1 The European Commission provides a platform for online dispute resolution, which you can find at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a point of contact for out-of-court resolution of disputes arising from online purchase or service contracts in which a consumer is involved.

12.2 The Seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
